It is the right of every person to criticise politicians and their decisions, but in the case of John Bergin I would like to correct an assertion he made in his Letter to the Editor on the 21^st of October (Carbon rage straight from the hymn sheet). Mr. Bergin said he did believe my statement that under the Clean Energy legislation there is provision for a 10 year gaol term. Under Offences and Criminal sanctions Table 7.5 Clause 273, 274, 275 and 276 (1) -3 it states "Scheme to avoid liability to pay unit shortfall charge or administrative penalty – intention, knowledge or belief - imprisonment for 10 years or 10,000 penalty units( currently $1.1 million) or both". If Mr. Bergin would like to contact my office I will be happy to provide a copy of the relevant legislation so he can be better informed.
